This Privacy Policy describes how OMG Nail Production LLC ("OMG," "we," "us," or "our") collects, uses, shares, and protects your personal information when you access or use the OMG mobile application, website at https://www.heyomg.us, and related services (collectively, the "Platform").

By using the Platform, creating an account, placing an order, or opting in to our messaging program, you acknowledge that you have read and understood this Privacy Policy. This Policy should be read together with our Terms & Conditions.

1. Information We Collect

We collect the following categories of information:

Information you provide to us:

• Account information, such as your name, email address, mobile phone number, and password
• Order and transaction information, such as billing and shipping address, products purchased, and order history
• Payment information processed through our payment providers (we do not store full payment card numbers ourselves)
• Business or trade account information, where you apply for trade pricing or credit terms
• Communications you send to us, including customer support messages and survey responses

Information collected automatically:

• Device and technical information, such as IP address, device identifiers, browser type, and operating system
• Usage information, such as pages viewed, features used, and interactions with the Platform

2. How We Use Your Information

• Verify your identity and secure your account (including OTP, MFA/2FA, and password reset)

• Send marketing and promotional messages where you have separately opted in
• Provide customer support and respond to your inquiries
• Detect, prevent, and address fraud, abuse, and security issues
• Operate, maintain, analyze, and improve the Platform
• Comply with legal obligations and enforce our Terms & Conditions

3. Legal Bases and Consent

Where required by law, we rely on your consent (for example, for marketing messages), the performance of our contract with you (for example, to fulfill orders), our legitimate business interests (for example, to secure the Platform), and compliance with legal obligations. You may withdraw consent for optional processing, such as marketing messages, at any time.

4. SMS & MMS Mobile Messaging

We operate two separate types of mobile messaging, each requiring its own consent: transactional/account messages and optional marketing/promotional messages. Marketing messages may include multimedia (MMS) campaign creative such as images, graphics, and video. You may opt out of marketing messages at any time by replying STOP, and you may reply HELP for assistance. Full details are set out in Section 13 of our Terms & Conditions.

Mobile information sharing. No mobile information (including your mobile phone number, text messaging opt-in data, and consent records) will be sold, rented, transferred, or shared with third parties or affiliates for their own marketing or promotional purposes.

We may share mobile information only with service providers and subcontractors that help us operate the messaging program and the Platform (for example, our messaging provider, customer support, and fraud-prevention vendors), and only to the extent necessary for them to perform those services on our behalf. Text messaging originator opt-in data and consent are not shared with any third parties for their own purposes.

5. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Platform, remember your preferences, maintain your session, analyze usage, and improve performance. You can control cookies through your browser settings, though disabling certain cookies may affect Platform functionality. Where required by law, we will request your consent before using non-essential cookies.

6. How We Share Information

We may share your information in the following circumstances:

Service providers. We share information with third-party providers that perform services on our behalf, including:

• Stripe (payment processing)
• Twilio (SMS/MMS verification, OTP delivery, and messaging)
• Firebase Cloud Messaging (push notifications)
• Sentry (application monitoring)
• Amazon Web Services (hosting and storage)

These providers are authorized to use your information only as necessary to provide services to us.

Legal and compliance. We may disclose information where required to comply with applicable law, legal process, or governmental request, or to protect the rights, property, or safety of OMG, our users, or others.

Business transfers. In connection with a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy.

With your direction. We may share information when you direct us to do so.

We do not sell your personal information, and we do not share mobile opt-in data with third parties for their own marketing purposes.

7. Data Retention

We retain personal information for as long as necessary to provide the Platform, fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials and OTP codes confidential.

9. Your Privacy Rights

Depending on your jurisdiction, you may have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate information
• Request deletion of your information
• Opt out of marketing communications
• Object to or restrict certain processing
• Request a copy of your information in a portable format

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising in a manner that requires an opt-out beyond the controls described above. 10. Children's Privacy

The Platform is intended for users who are at least eighteen (18) years old. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without appropriate consent, we will take steps to delete it.

11. Third-Party Links

The Platform may contain links to third-party websites or services that we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy policies.

12. International Users

The Platform is operated from the United States and is intended for users in the United States. If you access the Platform from outside the United States, you understand that your information will be processed and stored in the United States, where data protection laws may differ from those in your jurisdiction.
