These Terms & Conditions ("Terms") govern your access to and use of the OMG Nail Production LLC mobile application, website, and related services (collectively, the "Platform"), operated by OMG Nail Production LLC ("OMG," "we," "us," or "our").

By creating an account, accessing the Platform, using our services, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

OMG is an online store for beauty and nail supplies, including gels, acrylics, lacquers, professional salon products, and related beauty products.

The Platform is open to the public. Individuals and businesses meeting the eligibility requirements set forth below may create an account, browse available products, and place orders.

Registered trade customers may qualify for special pricing, volume discounts, or trade-credit programs where available.

2. Eligibility

You must be at least eighteen (18) years old or the age of majority in your jurisdiction and capable of entering into a legally binding agreement.

You agree to provide accurate, complete, and current information when creating an account and to maintain and promptly update such information as necessary.

You are responsible for all activities that occur under your account and for maintaining the confidentiality of your account credentials.

You may use the Platform only in compliance with these Terms and all applicable laws and regulations.

3. Your Account

You may register using your email address and password or by requesting a one-time passcode ("OTP") sent to your mobile phone number.

By providing your mobile phone number and requesting an OTP, you expressly consent to receive account-related SMS (text) and MMS (multimedia) messages from OMG, including:

Message and data rates may apply according to your wireless carrier's plan. MMS messages may incur higher charges than standard SMS messages.

You may opt out of SMS and MMS communications by replying STOP to any message, subject to limitations necessary to maintain account security and comply with applicable laws.

You are responsible for maintaining the confidentiality of your account credentials, passwords, and OTP codes.

Notify us immediately if you suspect unauthorized access to your account.

We may suspend, restrict, or terminate accounts that violate these Terms or that we reasonably believe are involved in fraudulent, unlawful, or abusive activity.

4. Products, Pricing & Availability

All prices are displayed in United States Dollars (USD) unless otherwise specified.

Applicable taxes, shipping charges, and fees may be added during checkout.

Trade pricing, volume discounts, tiered pricing, and minimum order quantities (MOQs) may apply to certain products and customers.

We strive to ensure that product descriptions, images, specifications, pricing, and availability are accurate. However, errors may occur.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information without prior notice, including after an order has been submitted.

Submitting an order constitutes an offer to purchase products.

A binding agreement is formed only when we confirm acceptance of your order.

Failure to pay outstanding balances may result in suspension of credit privileges, collection activity, account restrictions, and recovery of costs permitted by law.

Shipping, delivery, and pickup services are governed by our Shipping & Delivery Policy.

9. Returns, Refunds & Cancellations

Eligible products may be returned within thirty (30) days of delivery, subject to our Returns Policy.

13. SMS & MMS Messaging Program

OMG operates two separate types of mobile messaging: (a) transactional messages necessary to operate and secure your account, and (b) optional marketing messages. Each type requires its own consent, as described below. Opting in to one does not opt you in to the other.

13.1 Transactional & Account Messages

By providing your mobile phone number and requesting an OTP, you consent to receive SMS and MMS messages necessary to operate and secure your account, including:

13.2 Marketing & Promotional Messages (Optional)

If you separately opt in, you consent to receive recurring promotional SMS and MMS messages from OMG. These messages may include multimedia campaign creative such as images, graphics, and video, and may cover:

THE PLATFORM AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

OMG DOES NOT WARRANT THAT THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION OR ERROR.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMG'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

OMG SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR LOSS OF GOODWILL.

You agree to defend, indemnify, and hold harmless OMG, its affiliates, officers, employees, agents, and representatives from claims, liabilities, damages, losses, costs, and expenses arising from:
